Thompson Miller & Simpson PLC (“TMS”) provides litigation services to a wide range

Medical Liability summary judgment affirmed on appeal: The Court of Appeals
affirmed the Jefferson Circuit Court’s order granting defendant plastic surgeon’s
motion for summary judgment finding plaintiffs could not meet their burden of proof
without requisite expert

testimony, and the doctrine of res ipsa loquitur was not applicable in a case of
retained foreign body and post-operative infection after cosmetic surgery where
a piece of the device broke off and the surgeon had no reason to know a portion
was retained. Beth McMasters and Allison Wildman represented the surgeon for The
Medical Protective Company in the trial court and Brad Hume and Beth McMasters handled
the appeal.
